These Terms of Use ("Terms") govern your access to and use of the website operated by Access Virtual Staffing ("AVS," "we," "our," or "us") at https://www.accessvirtualstaffing.com and related marketing pages (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Our Services

The Site provides general information about AVS virtual staffing services, allows you to contact us, request information, subscribe to updates, and schedule strategy calls. The Site is for marketing and informational purposes.

Any staffing, recruiting, or client services you receive from AVS are governed by separate written agreements, proposals, statements of work, or order forms ("Service Agreements"). If there is a conflict between these Terms and a signed Service Agreement, the Service Agreement controls for the covered services.

2. Eligibility and Acceptable Use

You agree to use the Site only for lawful purposes and not to:

• Violate any applicable law or regulation
• Submit false, misleading, or unauthorized information through forms, chat, or email
• Attempt to gain unauthorized access to the Site, systems, or data
• Interfere with the security, integrity, or performance of the Site
• Scrape, harvest, or use automated means to access the Site without our prior written consent
• Use the Site to transmit malware, spam, or harmful code

3. No Employment or Placement Guarantee

Information on the Site about virtual assistants, candidates, pricing, or timelines is illustrative and subject to change. AVS does not guarantee that any particular candidate will be available, that a placement will occur, or that a virtual assistant will meet every business requirement. Hiring, supervision, and business outcomes remain the responsibility of the client except as expressly stated in a Service Agreement.

4. Intellectual Property

The Site and its content, including text, graphics, logos, images, layout, and software, are owned by AVS or its licensors and are protected by intellectual property laws. You may view and download content for your personal or internal business use in connection with evaluating AVS services. You may not copy, modify, distribute, sell, or create derivative works from Site content without our prior written permission.

5. User Submissions

If you submit information through the Site, including contact forms, chat, newsletter signups, or booking tools, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it. You grant AVS a non-exclusive right to use submissions to respond to your request, provide services, and operate our business in accordance with our Privacy Policy.

6. Third-Party Services

The Site may include links to third-party websites or embedded tools operated by third parties, including scheduling, chat, maps, and analytics providers. AVS does not control and is not responsible for third-party services, content, or privacy practices.

TO THE FULLEST EXTENT PERMITTED BY LAW, AVS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, AVS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW.

9. Indemnification

You agree to defend, indemnify, and hold harmless AVS and its officers, directors, employees, and agents from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. You agree that the state and federal courts located in Palm Beach County, Florida will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Site, except where applicable law requires otherwise.

11. Changes to These Terms

We may update these Terms from time to time by posting a revised version on the Site with a new effective date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
